Hello, my name is Joybilance!
I am a Visual Development and Story Artist with the goal of meeting as many people as I can, immersing myself in their created stories, and being a "visual guide" for those that need it. I often find myself interested in human nature and the innate ability to create and indulge in one's imaginations, and I think with this ability we can create beautiful things.
Throughout my time as an artist I had the opportunity to collaborate with amazing creators and fellow artists, as well as hear about their stories and imaginations.

GENERAL TOS

CLIENT RESPONSIBILITIES & RIGHTS

The Client holds image usage rights and practices the right to display the designs in their social media or personal purposes. Unless the commission is exclusively negotiated, The Client SHALL NOT monetize off of the illustration.
The Client is responsible for the following:
- Coordination of any decision-making with me
- Provision of content in a form suitable for usage in the deliverables
- Final proofreading of deliverables
- Clear, respectful, and professional communication

Ill and suspicious behavior and verbal attacks will result in me completely denying and cancelling your commission.
ALL WORK IS STRICTLY PROHIBITED FROM NFT AND AI USAGE. I DO NOT give consent in any way or form for my works to be utilized in either field. You will be reported for theft if I am informed or I see that my works are being used in such ways.

ARTIST RESPONSIBILITIES & RIGHTS

I practice the right to display my work in my social media and portfolio, unless explicitly requested. No communication about work privacy will default to public viewership.
I am responsible for the following:
- Coordination of any decision-making with the Client
- Delivering progress of the Commission within the appointed time (See Revisions for more information)
- Clear, respectful, and professional communication
- Updates on progress of the Commission if I am faced with interruptions or must withdraw for a period of time

If improper usage of my work is found (usage for monetization, vandalization, offensive media, claiming work as their own), I practice the right to deny any future commissions from said client and report them for the appointed misdemeanor. I retain the right to terminate the commission at any time without refund if my boundaries or terms are violated.

RESTRICTIONS

I have boundaries that may be stricter than what other artists will maintain, I ask that you respect these boundaries as you fill out my request form and during our communication pertaining to your commission. I will deny your commission if you request any of the following:

NSFW, Mature art, art with mature innuendos

I am generally an SFW artist, and I try my best to keep my portfolio clean of any implications. Furthermore, I am not experienced in NSFW or mature art.
I WILL allow art from characters that has slightly revealing clothing such as...
- chest windows (as long as it doesn't reveal more than half of the chest)
- bra-like features
- side windows
tight skirts/pants (as long as it does not reveal too much of the body).
- Swimwear (One-piece swimwear, Two-piece swimwear and swim trunks are allowed but I draw the line at Speedos and Bikinis)

I WILL NOT allow and draw art from characters that reveal too much of the body (chest is fully visible, lower midsection/crotch is fully visible). Additionally, I will not draw characters in lingerie or characters that are fully bare. I will not draw characters that imply or are implying mature or NSFW themes and/or innuendos, nor characters that are engaging in intimate acts or intercourse.

Furry Art

I am not a Furry artist, nor is my focus on animalistic characters. I allow characters with animal features (Kemonomimi) or, by scale, they are 30% animal and 70% human/human-adjacent. This is established out of comfortability and scope of skill.

Mecha Art

I am not a Mecha artist, nor is my focus on machines/robots. I allow characters with robotic features (ex. robotic arms, robotic legs, cyborg enhancements). This is established out of comfortability and scope of skill.

COMMERCIAL/MERCHANDISE USAGE

Commercial usage is defined as the usage of deliverables for a client's brand. Commercial usage may include, but is not limited to:
- Promotional/Marketing Content
- Free-To-Use Content (ex. Phone & Desktop Wallpapers, Emotes, Digital Stickers)
- Digital Assets (ex. Profile Pictures, Banners, Website Visuals)
- Live-Streaming Content (ex. Special Events, Live-Streaming Identity/Presence, Visual Assets for Live-Streaming)
- Music Albums
- Business Cards

All illustrations that will be used for commercial purposes will result in a fee of 50% of the original price.
Merchandise usage is defined as the usage of the deliverables for merchandise, or content that users must pay for in order to access.

Merchandise may include, but is not limited to:
- Physical Prints (ex. Posters, Postcards, Small-Scale Physical Illustrations)
- Keychains
- Standees
- Pins
- Stationary (ex. Notepads, Stickers)
- Apparel
- Pay-To-Use Digital Content (ex. Phone & Desktop Wallpapers)

All illustrations that will be used for merchandise purposes will result in a fee that is double (+100%) the original price. Alongside the initial fee, Royalty fees must also be negotiated between me and the Client. The Client is to offer Royalties of at least 10% of the sales made from the merchandise, and this is to be paid once per every month the merchandise is being sold.

DEADLINES AND DELIVERY

The final images will be sent as either a PNG or JPG file, as requested by the client.
The deadline for the illustration(s) will depend on the scale of the project.

PAYMENTS

The Client must be able to pay for their commission up-front. This is done to ensure that I will be receiving proper compensation for my work.
If the total amount of the Commission exceeds $100, the Client may request a payment plan. Unless the Client wishes to negotiate the payment plan, 50% of the payment must be made at the beginning of the commission and 50% of the payment must be made before final deliverables are sent.

REVISIONS

In order for the commission to be completed efficiently and smoothly, the Client must check in with me as their commission is updated. I will be giving updates to the Client about their commission at least once every 1-3 days. Within this period of time, the Client is to verify with me that they are either satisfied with the progress of the commission or they would like revisions to be made.
The client is generally entitled to the following number of revisions:
- Unlimited revisions during the sketch & prep phase
- 5 revision stages during the lineart and clean-up phase
- 5 revision stages during the coloring & painting phase
- 2 revision stages following final progress pictures
To be considered a revision stage, the client must offer 1 list of critiques and adjustments to the art – client MUST be thorough in their requests or else I will not follow through with it. If the client still wishes to be given a revisions stage when their number of stages exceed the count above, a $5 fee will be applied immediately. The client is to pay the fee first before the revision stage is accepted.
I will give the client up to 3 days to review the progress pictures and give a round of revisions. Failure to respond within this timeframe will result in me assuming I am able to continue working on the art. If unresponsiveness continues, I retain the right to refuse commission requests from the same client in the future.
Please understand that I am busy outside of commissions and I require professional, timely communication from my clients if I want to deliver satisfactory and high-quality art.

REFUNDS

All cancellations and refunds must be done within the span of the Sketch & Prep phase of the commission, otherwise I cannot cancel a commission. Half of the agreed-upon price will be refunded once both sides confirm the cancellation.
